Terms of Service

These terms are an agreement between you and HONNYDO LLC, an Arizona company based in Tempe, Arizona ("Vintage Garage Sale," "we," "us"). They cover your use of vintagegaragesale.com and our related tools, including the Vintage Garage Sale API and the Vintage Garage Sale MCP connection for AI agents (together, the "Service"). By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.

1. What Vintage Garage Sale is

Vintage Garage Sale is a marketplace where people, and AI agents acting for them, buy and sell physical items. Vintage Garage Sale provides the platform, holds payments during a sale, and helps resolve problems. We do not own, inspect, store, or ship the items. Sellers are independent individuals or businesses, not our employees or agents.

2. Who can use it

• You must be at least 18 and able to enter a binding contract.
• You must give accurate information and keep your account secure. You are responsible for everything done through your account, including by AI agents you connect to it.
• Sellers must verify their identity and complete payout setup with our payment provider before they can receive offers. Buyers pay by card at checkout.
• One person, one account. If your account is banned, you may not open another.

3. Real items, accurately described

This is the most important rule on Vintage Garage Sale. Every item listed must be:

• a real, physical item that the seller actually has in their possession when listing it;
• accurately represented in its photos, video, live looks, description, condition, and price; and
• legal to sell, and not stolen, counterfeit, recalled, or prohibited by law.

You may not list items you do not have, use photos or video that are not of the actual item, hide defects, or misrepresent an item in any way. Sellers may be asked to prove an item is real and in their possession with a live look or other proof, and must respond promptly.

4. Strikes, suspension, and bans

If a listing is false, misleading, or breaks these terms, we may remove it, add a strike to the account, suspend the account, or permanently ban it. Serious or repeated violations, including listing items that do not exist, may lead to an immediate lifetime ban. We may also hold or cancel related sales and refund buyers. Decisions about strikes and bans are made at our discretion, and you can contact us at support@vintagegaragesale.com to ask us to review one.

5. Offers and deals

• An offer is a proposal to buy at a price. Sellers may set a private minimum price. Offers at or above it become a deal; others are declined.
• When a deal is reached, the Pay Now link is sent to the buyer automatically, and the price is good for a short time. Items are not held: the item sells to whoever pays first, and if someone else pays first, you are refunded in full automatically. If the buyer misses the time, the price expires.
• To prevent spam, a buyer may make a limited number of offers per item per day, with a short wait between offers on the same item.
• You are bound by deals you accept or that your approved offer reaches, subject to section 7.

6. Payments, fees, and payouts

• Payments are processed by Stripe. We do not store your full card number. Stripe's own terms apply to payments, identity checks, and seller payouts.
• The buyer pays the agreed price. Vintage Garage Sale charges the seller a platform fee of 10% of the sale price, taken from the seller's payout (shipping charges are not part of the sale price and are paid to the seller in full). If the buyer chooses shipping, they also pay the seller's flat shipping price shown on the listing and at checkout. We may change fees for future sales by posting the change.
• You are responsible for any taxes that apply to your purchases and sales.

7. Vintage Garage Sale Protection

For a sale paid through Vintage Garage Sale, the following steps apply:

• We hold the money. After the buyer pays, Vintage Garage Sale holds the payment. The seller is not paid yet.
• Seller ships or hands off. If the buyer chose shipping, the seller must ship the item within 2 days of payment, to the address the buyer entered at checkout, and enter the carrier and tracking number. If the buyer chose local pickup, the seller has 3 days after payment to hand the item off in person and mark it as handed off. If they do not, the buyer is refunded and the sale is cancelled.
• Buyer checks. After the seller marks the item shipped or handed off, the buyer has 3 days to confirm that it matches the listing or to report a problem.
• Release. If the buyer confirms, or does nothing for 3 days, the seller is paid automatically.
• Problems. If the buyer reports a problem in time, the payment stays on hold while we review. We may release the payment to the seller or refund the buyer, based on the information available. Our decision on a dispute is final within the Service, but does not limit any rights you have under law.

Vintage Garage Sale Protection only applies to payments made through Vintage Garage Sale. Paying outside Vintage Garage Sale, such as in cash or with another app, is not covered, and we may ban accounts that move deals off the platform to avoid fees or protection. Protection is not insurance, and it does not cover buyer's remorse for an item that matches its listing.

8. AI agents, API keys, and connected apps

• The public listing data and API are provided for lawful use. We may rate-limit or block clients that abuse them.
• An agent can make offers only for an owner who has given it a key or signed it in. Every offer an agent proposes must be approved by the owner on Vintage Garage Sale before it is sent.
• You are responsible for the keys you create and for what agents do with them. Keep keys secret and revoke any key that may have leaked, on the Agent page of your account.
• You may not use agents or scripts to scrape private information, bypass limits, make false listings, or harass other users.

9. Photos, video, and live looks

You keep ownership of the photos, video, and text you upload. You give us a non-exclusive, worldwide license to host, display, and process them to run the Service, including showing listings to buyers and agents and keeping records for dispute review. Do not upload content that you do not have the right to use, or that includes other people's private information. Live looks and proof captures may be saved and reviewed to resolve disputes and enforce these terms.

10. Prohibited conduct

• Fraud, false listings, fake offers, or manipulating prices or reviews.
• Selling illegal, stolen, counterfeit, or dangerous items, or items we list as restricted.
• Harassing, threatening, or discriminating against others.
• Interfering with the Service, probing for weaknesses, or accessing accounts that are not yours.
• Creating accounts to evade a suspension or ban.

11. Our role and disclaimers

We provide the Service as it is and as it is available. We do not guarantee that any listing is accurate, that any item is safe or legal, or that any buyer or seller will complete a deal. To the fullest extent the law allows, we disclaim all warranties, express or implied.

12. Limit of liability

To the fullest extent the law allows, HONNYDO LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the fees we collected from you in the 12 months before the claim or $100. Some places do not allow these limits, so they may not apply to you in full.

13. Disputes between users

Buyers and sellers are responsible for their own deals. You agree to try to resolve disputes with the other party first, and to use our dispute process in section 7 for paid sales. Vintage Garage Sale is not a party to the sale contract between buyer and seller.

14. Ending your account

You may stop using the Service at any time. We may suspend or end your access if you break these terms, put others at risk, or if required by law. Sections that by their nature should continue, including payment obligations, disputes, and liability limits, continue after your account ends.

15. Governing law

These terms are governed by the laws of the State of Arizona, without regard to conflict of law rules. Any legal action will be brought in the state or federal courts located in Maricopa County, Arizona, and you agree to their jurisdiction.

16. Changes

We may update these terms from time to time. If we make a material change, we will post the new version with a new date and may notify you. Using the Service after a change means you accept the new terms.
